If someone loses functionality to the extent that they lack the ability to meet essential requirements for physical health, safety or self-care without appropriate assistance, a guardianship may provide authority in a guardian to meet those needs. Guardianship can include authority over a “person” (placement, care and medical needs) and/or over an “estate” (financial resource management). The authority granted to a guardian is balanced by several legal protections to ensure the authority granted is appropriate and subject to court supervision.
